Noelle Magennis is a Solicitor and Partner in the Criminal Defence Department.

Noelle represent clients at the Police Station and at the Magistrates Court in relation to guilty pleas. She is an experienced trial advocate. Noelle is one of the busiest Magistrates Advocate and Duty Solicitors in Sussex and attends Court every week representing clients on a variety of matters.

With the recent creation of Criminal Behavioural Orders Noelle has been increasingly representing clients in the County Court on these matters as well.

Career

Having graduated from Queen’s University Belfast with a Law LLB and completed the Legal Practice Course at the Chester College of Law Noelle completed Stage 1 of the Criminal Accreditation Scheme in 2005. She qualified as a Solicitor in October 2009 and was admitted as a Duty Solicitor in May 2010. Noelle was made a Partner in 2022.

Specialisms

Noelle is a Prison Law Supervisor. She is one of the few Solicitors in Sussex who represents clients in Prison Law proceedings. Noelle represents clients from recall back to custody cases, providing written representations to the Parole Board and attending oral cases before the Parole Board. Adjudications before the Independent Adjudicator and many other aspects of Prison Law.

Notable cases

R v CC – Current matter – representing the defendant on a breach of planning notice.

R v RVDM (2020) – Successfully imposed the imposition of a Stalking Protection Order.

R v CS (2020) – Successfully imposed the imposition of a Domestic Violence Protection Order.

R v CP (2020) – Defendant acquitted of assault by beating, criminal damage.

R v CS (2020) – Make representations to the CPS which resulted in the matter being discontinued for Defendant on remand on a domestic assault occasioning actual bodily harm.

R v DB (2020) – Successfully opposed the imposition of hearsay on an assault occasioning actual bodily harm.

R v SM (2020) – Defendant pleaded to breach of restraining order x 2 and assault by beating. Successful mitigation resulted in a suspended sentence.

R v DO (2020) – Defendant pleaded guilty to assault occasioning actual bodily harm x 2. Successful mitigation resulted in a suspended sentence.

R v ID (2020) – Defendant pleaded guilty to breach of non-molestation order. Due to the time he spent in custody was able to secure a sentence of a fine deemed served.

R v PL (2019) – Defendant was acquitted of offences of taking a motor vehicle without consent, dangerous driving and driving without a licence or insurance.

R v LT (2019) – Defendant was acquitted of drink driving.

R v PM (2019) – Defendant had 19 offences of shop theft. Successfully mitigated and Defendant was sentenced to a community order.

R v SB (2019) – Defendant had offences of shop theft and assault by beating. Successfully mitigation led to a community order.

R v SB (2019) – Defendant pleaded guilty to two assaults on emergency workers and was sentenced to a conditional discharge.

R v HH (2018) – Defendant pleaded guilty to three x drink driving. Successful mitigation resulted in 36-month disqualification and conditional discharge.
