High Court Decision: Favourable Ruling on Ownership Status of Illegally Transferred Properties to Our Client

Jerome Soucek, a senior associate in our Dispute Resolution Team, represented the Fifth Defendant in a High Court case concerning property ownership. The properties in question had been unlawfully transferred to our client, resulting in their partial ownership of a large rural property. This led to ongoing litigation, as our client was used as a way to divert assets.

There were five Defendants, one Claimant, and one Counterclaimant involved in the case. Each party had different issues and disputes, but all were interconnected, making it a complex decision for the Judge. Our role was to navigate these complexities on behalf of our client, ensuring the best possible outcome while protecting their interests.

The litigation spanned multiple legal proceedings over several years, including a High Court trial and subsequent hearings.

Ultimately, the High Court judge ruled in favour of our client, declaring the transfer void and ordering it to be held in trust as our client had requested. Additionally, our client was granted an order to cover their legal costs.

This case was exceptionally complex due to the various parties involved, each with different goals and legal arguments.
